By having your photograph taken in the Newton Machine in Topshop Oxford Circus, Manchester Arndale and Dublin St Stephens Green:

1. you consent to the following:

• - to grant to Topshop, free of charge, permission to post any resulting photograph of you in any way, including (but not limited to) in Topshop stores and in The Gallery on www.

  .com ("the Website");
• - that Topshop shall own the copyright in any resulting photograph of you; and

2. you confirm that you are either 16 years of age or over, or, if you are under 16, that

you have the consent of a parent or guardian to have your photograph taken in the Newton Machine.

One photograph only per customer. Each customer will receive one print-out of the image taken of them in the Newton Machine. You cannot select your chosen image, this will be done automatically by a digital operator on behalf of Topshop. The photograph taken of you has no monetary value and is therefore non-exchangeable and non-refundable.

Entrance to the studio will be on a first come first served basis and will be free of charge. We cannot guarantee each customer will be able to use the facility however we will endeavour to meet needs wherever possible.

Topshop shall not be liable to any customer any failure or inability of a customer to use the Newton Machine for any reason. Topshop reserves the right to vary or terminate the Newton Machine Project or these terms and conditions at any time without notice.

The failure of Topshop to take any action in respect of a breach of these terms and conditions shall not constitute a waiver of their enforceability. Topshop reserves its rights in respect of these terms and conditions at all times.
